DMCA & Copyright Infringement Policy
RAWTRAK complies with the United States Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512) and the Copyright Act of Korea.
If you believe your copyrighted work has been infringed upon, please follow the procedures below.
1. Notice Processing Timeline
Upon receipt of a valid DMCA notice: (1) infringing content distribution suspended within 5 business days, (2) artist notified via email of the takedown and reason, (3) artist informed of their right to file a counter-notification.
⚠️ False Claims Warning
Under 17 U.S.C. § 512(f), knowingly submitting a materially false DMCA notice may subject the claimant to liability for damages. Korean Copyright Law notices under Article 103 are also accepted at the same email.
2. Filing a Copyright Infringement Notice (DMCA Takedown)
To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- 1.A physical or electronic signature of the copyright owner or authorized agent
- 2.A description of the copyrighted work infringed (track title, album, original link or registration number, etc.)
- 3.Identification of the infringing content on RAWTRAK (release ID, track title, artist name, URL, etc.)
- 4.Your contact information (name, address, phone number, email)
- 5.A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner
- 6.A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf
3. Counter-Notification
If you believe your content was removed due to a mistake or misidentification, you may submit a counter-notification to dmca@rawtrak.com with subject [COUNTER] Artist Name — Track Title. Your counter-notification must include all of the following:
- 1.Your physical or electronic signature
- 2.Identification of the content that was removed (track title, release ID, etc.)
- 3.A statement under penalty of perjury that you have a good-faith belief the content was removed by mistake or misidentification
- 4.Your name, address, phone number, and email
- 5.A statement consenting to the jurisdiction of the federal courts in the State of Delaware, USA
Processing: Original claimant notified immediately. If no court action is filed within 10 business days, RAWTRAK will restore the content within 10–14 business days. If a court action is filed, content remains suspended pending the court's decision.
4. Repeat Infringer Policy (3-Strike Policy)
Pursuant to DMCA Section 512(i), RAWTRAK maintains a policy of terminating accounts of repeat infringers. 1st valid notice: Content suspended + warning issued 2nd valid notice: Content suspended + final warning issued 3rd valid notice: Account permanently terminated + all content removed Unpaid royalties on terminated accounts are frozen and handled in accordance with legal obligations and rights holder claims. Strikes are removed for claims where a valid counter-notification is accepted.
